der übereinstimmungsnachweis (§ 24 MBO) unterscheidet drei mögliche Verfahren (üH, üHP, üZ) je nach Sicherheitsrelevanz des Bauprodukts für die bauliche Anlage, für die es verwendet wird. Bei den Verfahren üHP und üZ sind beim übereinstimmungsnachweis staatlich anerkannte Prüf-, überwachungs- und Zertifizierungsstellen (sogenannte PüZ-Stellen) nach § 24 c Abs. 1 MBO zur Prüfung und Bewertung der Bauprodukte vertraglich einzuschalten. Die Bestätigung der übereinstimmung aufgrund des übereinstimmungszertifikates einer anerkannten Zertifizierungsstelle setzt eine Fremdüberwachung mit laufender Kontrolle der Produktherstellung durch eine überwachungsstelle voraus. Bei der übereinstimmungserklärung kann eine einmalige Erstprüfung des Bauproduktes durch eine dafür anerkannte Prüfstelle gefordert werden, während im einfachsten Fall der Hersteller allein die übereinstimmung seines Produktes mit den technischen Regeln erklären kann (üH-Verfahren). Zentrales Element aller drei übereinstimmungsnachweisverfahren ist die vom Hersteller durchzuführende werkseigene Produktionskontrolle zur überprüfung und Bewertung des Bauproduktes sowie zur Steuerung des Produktionsablaufs. Schon bisher galt diese ureigene Unternehmenstätigkeit als der entscheidende Bestandteil der bis etwa zum Jahre 1995 für "überwachungs- und prüfzeichenpflichtige Baustoffe und Bauteile" vorgeschriebenen Eigen- und Fremdüberwachung. Bauprodukt-Kennzeichnung; Abschluss des übereinstimmungsnachweises bildet die Kennzeichnung des Bauprodukts mit dem ü-Zeichen durch den Hersteller selbst gemäß den Vorgaben der übereinstimmungszeichen-Verordnung. Das übereinstimmungszeichen ist somit für alle am Bau Beteiligten augenfälliges Merkmal der nachgewiesenen Verwendungsfähigkeit des Bauprodukts; es darf nach § 24 MBO angepasst an die baupraktischen Gegebenheiten für Lieferung, Lagerhaltung und Verwendung der Bauprodukte, auf dem Bauprodukt selbst, auf einem Beipackzettel oder auf seiner Verpackung oder, wenn dies Schwierigkeiten bereitet - wie z. B. bei in größeren Mengen angeliefertem Betonzuschlag aus Sand und Kies -, auf dem Lieferschein oder einer Anlage zum Lieferschein angebracht werden.
