Une oeuvre tombe dans le domaine public à une date déterminée après la mort de son auteur. Cette date, variable selon les pays, est souvent de 70 ans après la mort de l’auteur, et parfois de 50 ans dans le cas de législations moins contraignantes. Avant cette date, l’oeuvre est soumise au copyright. On parle aussi d’une oeuvre sous droits. A la date dite, il devient possible d’utiliser l’oeuvre et de la diffuser librement, y compris sur l’internet. C’est la raison pour laquelle des bibliothèques numériques telles que Gallica ou le Projet Gutenberg diffusent essentiellement des oeuvres du domaine public, qui sont donc libres de droit. Ceci n’autorise pas pour autant la mutilation ou la déformation de l’oeuvre, le droit moral de l’auteur (respect de l’oeuvre et paternité de celle-ci) étant intemporel. Le New General Catalog of Old Books and Authors est une liste en cours de constitution de plusieurs centaines de milliers d’auteurs morts dont les livres ont été publiés avant 1964, pour permettre de déterminer si un livre appartient au domaine public ou non, en fonction de la législation d’un pays donné.
