Казенное предприятие, а также учреждение, ведущее некоммерческую деятельность, обладают правом оперативного управления. В соответствии со ст. 296 ГК РФ они осуществляют в отношении закрепленного за ними имущества (в пределах, установленных законом) в соответствии с целями своей деятельности, заданиями собственника (государства) и назначением имущества следующие права владения, пользования и распоряжения им (см. ст.297 ГК): - право отчуждать или иным способом распоряжаться закрепленным за ним имуществом лишь с согласия собственника этого имущества; - право самостоятельно реализовать производимую им продукцию, если иное не установлено законом или иными правовыми актами. Порядок распределения доходов казенного предприятия определяется собственником его имущества, т.е. огосударством. См. Хозяйственное ведение
