1 RESTRICTIVE TRADE AGREEMENT
Соглашение, ограничивающее предпринимательскую деятельность
Сговор между производителями, целью которого является устранение или ослабление конкуренции. В основном такие соглашения имеют целью установление общих цен и скидок, но в них также могут оговариваться производственные квоты, доля на рынке и др. Ограничительные соглашения оказывают отрицательное влияние на конъюнктуру рынка, что приводит к росту цен и неэффективности производства. 4 RESTRICTIVE PRACTICES COURT (RPC)
Суд по делам об ограничительной деловой практике
Государственное учреждение в Великобритании, отвечающее за исполнение конкурентной политики (см. Competition policy). Основной задачей суда являлось изучение случаев ограничительной деловой практики, сведения о которых поступают из Управления по вопросам добросовестной конкуренции (см. Office of fair trading). В 1998 г. функции Суда были переданы Комиссии по конкуренции (см. Competition Commission) на основании Закона о конкуренции 1998 г. Считается, что все соглашения об ограничительной практике противоречат интересам общества, если обратное не доказано сторонами этого соглашения (например, что соглашение способствует повышению эффективности, увеличению экспорта, созданию рабочих мест). Если устанавливается, что соглашения наносят ущерб интересам общества, они автоматически признаются недействительными. См. 9 COLLUSION
Сговор
Тактика поведения фирм в условиях конкуренции, которая состоит в том, что фирмы заключают тайное письменное или устное соглашение о совместных действиях на рынке. Соглашение достигает своей цели, если все фирмы ставят перед собой общую задачу (например задачу максимизации прибыли) и подавляют любые действия, препятствующие ее решению (например ценовую конкуренцию). Обычно фирмы прибегают к тайному сговору, если хотят монополизировать производство товара с целью получения монопольной прибыли, или если стремятся защитить себя от неблагоприятных условий торговли, например, от резкого падения цен. Однако ввиду отрицательного влияния такой тактики на эффективность функционирования рынка она запрещена во многих странах (за исключением отдельных случаев). См.
