    praescriptio, отметка, оговорка, клаузула, возражение, которое в формулярном производстве помещалось в начале исковой формулы, как дополнительная часть, а) чтобы истцу, который для осуществления своего требования предъявляет иск, дать возможность вторично подавать жалобу по поводу других претензий (особ. при срочных взносах), которых срок платежа еще не истек;

    b) чтобы подвергнуть исследованию возражение (напр. praesc. praeiudicii) ответчика. Co времен Гая все praescrip. pro reo приняли форму эксцепции (Gai. IV, 131-137); с) praescriptis verbis agere, actio, iudicium, иск, который, как общий, применялся для защиты неформальных соглашений (pacta), при безыменных договорах, и содержал в начале формулы подробное описание обстоятельств, на которых основывался (1. 7 § 2 D. 2, 14. 1. 13 § 2 D. 13, 6. 1. 1 § 9 D. 16, 3. 1. 2. 7. 8 13 § 1. 1. 15. 22. 24 D. 19, 5); иногда наз. actio, quae praescr. verbis rem gestam demonstrat (1. 6 C. 2, 4);
