Нас интересует лишь русский перевод этого термина, определение которого возьмем из Columbia Encyclopedia: affirmative action – in the United States, programs to overcome the effects of past societal discrimination by allocating jobs and resources to members of specific groups, such as minorities and women. Г.В. Чернов в словаре Americana предлагает перевод позитивные действия, что без пояснений мало информативно. В нашей печати в последнее время используется выражение позитивная дискриминация, но в основном в применении к женщинам. К тому же по-английски существует и positive discrimination, и нехорошо, когда два разных термина переводятся одним соответствием.
•• Обсуждение этого термина на сайте www.lingvoda.ru дало множество вариантов, например, квотирование по расовому/половому/возрастному признаку, меры по предотвращению дискриминации, компенсирующая политика, поддерживающие действия и т.д.
•• Квотирование точно не подходит, так как это лишь одна из возможных форм affirmative action, к тому же жесткое квотирование было оспорено в суде, который согласился с аргументами о его незаконности в большинстве случаев. •• Не выражает сути явления и вариант меры по предотвращению дискриминации – ведь идея состоит в том, чтобы преодолеть последствия угнетения, дискриминации, имевших место в прошлом (см. определение в Columbia Encyclopedia). Так что компенсирующая политика в этом смысле точнее, но этот вариант, а тем более поддерживающие действия, кажется мне довольно неуклюжим.
•• Думаю, что неплохим вариантом, сочетающим сжатость и информативность, было бы предоставление преимущественных прав.
•• Возражение, что слово преимущественных содержит в себе оценочный элемент и намекает на несправедливость affirmative action, не кажется мне убедительным. Как раз наоборот: по-русски выражение преимущественные права звучит довольно нейтрально. Во всяком случае, оно не отягощено большим негативным грузом (известная формулировка «преимущественным правом при поступлении в вуз/на работу пользуются лица, прошедшие военную службу/ветераны/инвалиды» воспринимается довольно спокойно).
