7 LETTER OF CREDIT
(DOCUMENTARY CREDIT) (аккредитив,кредитное письмо) Письмо, адресованное одним банком другому, в котором содержится указание выплатить лицу, названному в письме, определенную сумму денег при определенных оговоренных условиях (см.: letter of indication( идентификационное письмо)). В торговле аккредитивы широко используются для проведения расчетов за импорт и экспорт. В экспортном контракте экспортер может потребовать у иностранного импортера открыть ему аккредитив в своем местном банке (банк-эмитент) на сумму, равную стоимости товаров. В контракте будет указываться, что он может быть передан банку (принимающему банку) в стране экспортера на имя экспортера. Часто экспортер, который называется бенефициаром, получателем кредита, сам называет принимающий банк. По представлении погрузочных документов (shipping documents), которые вносятся в аккредитив, принимающий банк выплачивает деньги получателю кредита. Безотзывный аккредитив (irrevocable letter of credit)-аккредитив, который не может быть закрыт лицом, его открывшим, или банком-эмитентом без согласия получателя кредита, в то время как отзывный аккредитив (revocable letter of credit) может быть закрыт. В подтвержденном аккредитиве (confirmed letter of credit) учитывающий банк гарантирует выплату получателю кредита даже в том случае, если банк-эмитент не выполнит своих обязательств (в случае неподтвержденного аккредитива подобные гарантии не предоставляются). Таким образом, наиболее надежные гарантии выплаты за экспортируемые товары дает подтвержденный безотзывный аккредитив. Тем не менее все аккредитивы имеют определенный срок действия, по истечении которого выплаты по ним могут производиться только с согласия всех сторон. Циркулярный аккредитив (circular letter of credit) представляет собой инструмент, направляемый каким-то банком своим банкам-корреспондентам, уполномочивающий их выплатить бенефициару определенную сумму по представлении документов, удостоверяющих его личность. Сегодня его заменили дорожные чеки (travellers cheques). Хотя до сих пор термин “аккредитив” продолжает широко использоваться, в 1983 г. Международная торговая палата рекомендовала применять вместо него термин дoкументарный аккредитив (documentary credit). -
