Минимальный размер заработной платы в час периодически изменялся со времени принятия Закона о справедливых условиях труда 1938 года [ Fair Labor Standards Act of 1938]. Так, в 1949 он был установлен на уровне 75 центов, а в 1974 на уровне 2,25 доллара. Периодически приводится в соответствие с индексом потребительских цен [ consumer price index]. В 2003 минимальный размер заработной платы в час составлял 5,15 долларов. Это не относится к работникам предприятий малого бизнеса с годовым доходом менее 500 тыс. долларов.
