вещное, наследственное, отчуждаемое право пользования чужим поземельным имуществом, с обязанностью вносить собственнику земли ежегодную ренту (pensio, canon), и платить общественные налоги: наследственная аренда, эмфитевзис, эмфитевтическое право (tit. C. 4, 66. § 3 J. 3, 24). Уже во время Республики муниципии отдавали в наймы земли частным лицам на продолжительные сроки или навсегда за известную ежегодную пошлину, которая называлась vectigal, а земли оброчные - agri vectigales - самое право - ius ип agro vectigali. В III столет. по Р. X. императорские земли отдавались за известную плату в наследственную аренду. Земли такие носили название agri emphyteuticarii, и эту аренду стали только называть emphyteusis, ius emphyteuticum. Впоследствии подобное отношение встречается и при частных поземельных имуществах: contractus emphyleuticarius - emphyteuseos contractus (§ 3. 5. cit.);res, quae per emphyteusin data est (1. 1 C. cit.); (1. 2 eod.);
