При императоре Анастасие эмансипация происходила на основании императорского рескрипта (emancipatio Anastasiana) и применялась именно inter absentes. 1) посредством торжественной, фиктивной продажи отчуждать;mancipatio, такая торжественная форма приобретения права собственности, которая имела место а) по древнему рим. праву, как гражданская форма б) для приобретения собственности; в присутствии пяти свидетелей (cives romani puberes) весовщик (libripens) отвешивал продавцу (mancipio dans) нечеканенную медь (aes), представляющую собой покупную цену, а покупатель (mancipio accipiens) схватывал купленную вещь, произнося торжественные слова, в которых он называл эту вещь своей собственностью (Gai. I. 119-122. Ulp. XIX, 3-6. Vat. § 50). Исчезновение манципации относят к половине IV века по P. X. (1. 4. 5 C. Th. 8, 12); в) для установления сельских сервитутов (servitus praediirustici) (Gai. II. 29);
b) далее применялась манципация для составления завещания (testamentum per aes et libram); завещатель продавал (imaginarie) свое имущество (familia), в присутствии пяти свидетелей и весовщика, душеприказчику (familiae emtor) для того, чтобы затем в торжественных словах (nuncupatio, см.) возложить на него выполнение заключающихся в завещании предсмертных распоряжений (Gai. II. 102-108. Ulp. XX, 2-9. § 1. I. 2, 20); с) тк. dicis causa как вводный акт эмансипации; чтобы освободиться из под отеческой власти эмансипируемый сын должен был пройти через mancipium, т. е. он подлежал мнимой продаже, которая совершалась три раза. Только после троекратной манципации и manumissio сын становился persona sui iuris (Gai. I. 132-135. II. 142. Ulp. X, 1); оттуда mancipatio употребляется тк. в значении emancipatio (Paul. II. 25 § 2. 1. 8 C. Th. 15, 14); тк. = mancipium s. 2: ex mancipatione manumitti (Gai. I. 135-162); иногда и усыновление (adoptio) совершалось по древ. p. праву через акты продажи и уступки в суде (mancipatio и in iure cessio) (Gai. I. 134);
d) при заключении рим. брака cum manu, посредством coemtio, применялась тк. манципация (Gai. I. 133. cf. coemtio);
2) брать на откуп, как manceps (см. s. 1); (1. 2 C. 10, 55). 3) посвящать, включать, mancipari curiis (1. 14. 18 C. Th. 12, 1);e) далее в обязательн. отнош. при nexum (см.).
4) передавать, mancipari custodiis (1. 4 C. Th. 9, 3. 1. 19 C. Th. 9, 40);sponte se manc. ministerio censuali (1. 4 C. Th. 8, 2).
5) снабжать, наделять: praemio mancipari (1. un. C. 10, 13).flammarum exustionibus (1. 2 C. 9, 24).
