Самым распространенным видом товарного знака является фирменное название товара [ brand name]. Использование чужого товарного знака преследуется по закону. Закон о регистрации товарных знаков был принят Конгрессом США [ Congress, U.S.] в 1870, а поправки к нему - в 1881, 1905 и 1946 [Lanham Trademark Act]. Регистрируются Бюро патентов и товарных знаков [Patent and Trademark Office] на 10-летний срок, который может быть продлен. Существует несколько категорий товарных знаков: т.н. технический товарный знак, например бессмысленное слово или буквосочетание (считается "сильным", так как менее подвержен подделке); описательный товарный знак ("слабый", с трудом поддается защите) и различные промежуточные варианты. Примером технического товарного знака является "Twinkies" (Twinkies), описательного - "Webster's Dictionary" (Webster's Dictionary). -

In the United Kingdom, a trademark can be registered at the Register of Trademarks, giving the producer or trader protection from fraudulent use. Any use of the trademark without permission gives the owner the right to sue for damages. -
