(тк. superficium); 1) все то, что находится на поверхности земли, над землей, напр. строение, дом, дерево, все, связанное с поверхностью земли, прот. area, solum (1. 71 D. 7, 1. 1. 3. 20 pr. D. 8, 1. 1. 13 pr. D. 8, 3. 1. 29 § 2 D. 20, 1. I. 44 § 1 D. 44, 7. 1. 98 § 8 D. 46, 3. Gai. II. 73). 2) здание, которым может пользоваться наследственно третье лицо, а не собственник земли, на которой возведено строение (tit. D. 43, 18). 3) superficium - есть вещное (ius in re aliena), полное наследственное и отчуждаемое право пользоваться строением, возведенным на чужой земле, с обязанностью вносить собственнику участка (solum) определенную наемную плату (solarium, pensio).
