1) судебное разбирательство и решение спорных дел, causae cognitio a) частными судьями (judices) (l. 36 pr. 1. 73 § 1 D. 5, 1. 1. 17 D. 27, 10. 1. 135 § 2 D. 45, 1);b) или сановниками (magistratus). Высшие сановники обыкновенно сами не решали спорного дела, а лишь приготовляли и передавали его для дальнейшего рассмотрения и решения известному судебному ведомству или же частным судьям (jadices, arbitri, recuperatores), отсюда различалось судопроизводство обыкновенное (cognitio ordinaria) и экстраординарное (cog. extraordinaria): последнее имело место, когда спорное дело рассматривалось и решалось самым высшим сановником (1. 9 § 1 D. 1, 16. 1. 8. 9. D. 1, 18 1. 13. 16. pr. 1. 24 § 5. 1. 39 pr. D. 4, 4. 1. 1 § 2 D. 6, 1. 1. 39 pr. D. 21, 2. 1. 2 § 1 D. 38, 15. tit. D. 50, 13);
c) императором (1. 92 D. 28, 5. 1. 22 D. 49, 1);
2) следствие по уголовным делам (1. 17 § 2 D. 44, 4. 1. 3 pr. D. 47, 20. 1. 1 § 8 D. 48, 16. 1. 10 § 5 D. 48, 18);d) советником наз. assessor (1. 1 D. 1, 22).
3) следствие, освидетельствование (1. 6 pr. D. 1, 16).custodiarum cogn., допрос арестованным (1. 6 pr. D. 1, 16).
