Гражданское правонарушение, когда нарушение обязанности соблюдать интересы (duty of care) ведет к нанесению ущерба лицу, чьи интересы должны соблюдаться. Такие обязанности имеет производитель в отношении потребителей, покупающих его продукцию; специалисты в отношении клиентов, которым они оказывают услуги; директор компании в отношении ее акционеров и т.д. Лицо, которое понесло убытки или получило травмы в результате нарушения обязанности соблюдать интересы, может потребовать возмещения по делу о гражданском правонарушении.
