Во всех делах федеральной юрисдикции [ federal case] при рассмотрении дел "о серьезных преступлениях", то есть тех, наказание за которые превышает шесть месяцев тюремного заключения, отправление правосудия осуществляет малая коллегия из 12 или 6 (по решению Верховного суда [ Supreme Court, U.S.] 1970) присяжных [ petit jury]. Она рассматривает судебное дело по существу и выносит решение о виновности обвиняемого [ verdict], которое должно быть единогласным. Большая (следственная) коллегия присяжных [ grand jury] в составе 12-23 человек решает вопрос о предании обвиняемого суду присяжных и предъявляет ему обвинительный акт [ indictment]. В делах, входящих в юрисдикцию штатов, в некоторых случаях состав малой коллегии присяжных может быть меньше 12 человек (но не менее шести) и возможны отступления от правила единогласия (по решению Верховного суда 1972).
