Состояние человека, скончавшегося без завещания. В таком случае говорят, что он умер, не оставив завещания (intestate). Собственность может быть оставлена полностью без завещания (если таковое вообще не было составлено) или частично (если завещание охватывает не всю собственность скончавшегося). В Законе о распоряжении собственностью подробно регламентируется распределение имущества, оставленного без завещания. Если скончавшийся без завещания не имеет близких родственников, но у него осталась супруга, все имущество переходит к ней. Если у него остались дети или внуки, то к супруге переходит 40 000 ф. ст. плюс пожизненный процент с половины остальной собственности. Остальное отходит к детям или к внукам. Если его пережили супруга и другие близкие родственники, но у него нет детей или внуков, супруга получает 85 000 ф. ст. плюс половину остального имущества, а все оставшееся переходит к самым близким из оставшихся родственников. Если у покойного нет родственников, его имущество отходит к Короне как безхозное имущество (bona vacantia).
