Workers' Comp Law эк. тр., страх., амер. закон "О компенсации за производственные травмы"* (название законов, действующих в ряде штатов США, направленных на обеспечение наемных работников денежной компенсацией за травму, полученную на рабочем месте; покрывает все виды травм, полученные на рабочем месте, даже если они явились следствием небрежности самого пострадавшего; пострадавший работник имеет право получать компенсацию за ущерб, оплату счетов за лечение и возмещение заработной платы, а также пожизненную пенсию или значительную сумму единовременной денежной компенсации, в зависимости от степени тяжести полученных травм; по закону работник не может подать в суд на своего работодателя, если он рассчитывает получать данную компенсацию; работодатель оплачивает компенсационное страхование работников штату или частной компании, что ограждает его от исков со стороны собственных работников, а последних, в свою очередь, обеспечивает финансовой защитой; если травмы, полученные работником, являются виной не работодателя, а третьей стороны, пострадавший может подать в суд на третью сторону, не теряя права на получение компенсации; до появления подобных законов получивший травму на рабочем месте имел право подавать в суд на своего работодателя, после чего его обычно увольняли, и до начала судебного разбирательства, обычно через 2-3 года после несчастного случая, пострадавший и его семья были вынуждены обращаться за финансовой помощью в общественные организации; кроме того, до получения компенсации пострадавший должен был сам оплачивать расходы по лечению; в штате Нью-Йорк подобный закон был принят в 1909 г.; в 1911 г. закон был объявлен недействительным, потому что в соответствии с ним работодатель лишался имущества без права обращения в суд; но затем законодательством штата была принята поправка к Конституции штата Нью-Йорк о введении системы компенсации за травмы на рабочем месте; поправка вошла в силу, и в 1914 г. закон вновь был принят и действует во всех судах штата Нью-Йорк по настоящее время; аналогичный закон имеется в штате Алабама, Калифорния, Флорида и некоторых других)See:Англо-русский экономический словарь > Workers' Compensation Law
