se immiscere (hereditati s. bonis) касается особ. т. н. sui et necess. Heredes, т. e. наследников, которые, ipso jure приобретая наследство, совершают такие действия, из которых несомненно следует воля их быть наследниками, прот. abstinere (§ 5 J. 2, 19. 1. 11. 38. 56. 57. 91. D. 29, 2); тк. обозн. подназначенного наследника (pupillariter substitutus), который gerit pro herede, т. е. совершает такое действие, которое считается действием в качестве наследника (1. 41 eod.); иногда выражение se immisсere относится к т. н. filius emancipatus, который, после принятия наследства, получил restitutionem in integrum и опять принял наследство (si fuerit rursus immixtus - 1. 2 § 10 D. 38, 17).
