Hypothek, hypotheca (ὑποϑήκη). – pignus (Pfand übh.). – etwas als H. geben, verpfänden, remhypothecae nomine obligare (ICt.): doppelte H. geben, in duplum cavere, auch jmdm., alci (absol. od. an Grundstücken, praediis): H. erhalten, hypothecam accipere: sich etwas als H. geben, verschreiben lassen, alqd pignori accipere: als H. gegeben, verpfändet, worauf H. haftet, ruht, obligatus: die H. abtreten, de hypotheca decedere: die H. ist verfallen, hypotheca commissa est, jmdm., alci.

Pfand, pignus (übh. eine Sache, die man einem andern zur Bürgschaft oder Versicherung übergibt, einhändigt, bes. einem Gläubiger zur Sicherheit seines Darlehns; daher auch bildl. = sicheres Kennzeichen, Unterpfand). – hypothēca (Hypothek; das dem Gläubiger zur Sicherheit seines Darlehns angewiesene unbewegliche Pfand, wie Grundstücke etc.). – fiducia (eig. die Sicherheit durch ein Pfand; dann auch das Pfand selbst). – arrăbo (Angeld, Kaufschilling). – ein Pf. geben, dare pignus: etw. als Pf. od. zum Pf. geben, setzen, alqd oppignerare; alqd pignori dare od. obligare od. opponere; fiduciarum dare alqd: sichselbst zum Pf. geben, se pignori opponere: seinen Kopf zum Pf. setzen, caput suum obligare: etwas als Pf. haben, alqd pignori habere: sein Wort als Pf. geben, fidem interponere; jmdm., subsignare apud alqm fidem: ein Pf. nehmen, bekommen, pignus capere, auferre; fiduciam accipere: etwas zum. Pf. bekommen, alqd pignori accipere: bei jmd. etwas als Pf. niederlegen, apud alqm pignori ponere alqd: (Geld) gegen oder auf Pfänder (ver)leihen, (ver)borgen, pecunias fenore occupare pignoribus oder fiduciis acceptis: ein Pf. einlösen, pignus reluere; pignus liberare (a creditore). – Bildl., ein Pf. der Freundschaft, des Wohlwollens, pignus voluntatis, benevolentiae: ein Pf. der Liebe, pignus amoris (sowohl von Sachen als auch, wie bei uns, von einem Kinde); arrabo amoris (von Sachen): die Pfänder der Liebe (d. i. Kinder), pignora: ein Pfand des Friedens, s. Friedenspfand.
