nCultural note: FEDERAL COURT Negli Stati Uniti esistono le federal courts in cui si svolgono i processi per le violazioni alle leggi federali e quelli in cui il reato vede coinvolto più di uno stato, e le "state courts" per i reati contro le leggi statali. Così come ha un proprio sistema giudiziario, ogni stato ha infatti il potere di legiferare (sempre nel rispetto della Costituzione e delle leggi federali). Negli Stati Uniti non esiste la distinzione fra tribunale penale e civile. La maggior parte delle controversie federali viene giudicata nelle "district courts", mentre 12 "Courts of Appeal" giudicano in appello le cause provenienti dalle "federal courts" di grado inferiore. Il tribunale superiore, sia a livello federale che statale, è la "Supreme Court". I "solicitors" di solito forniscono assistenza legale in materia di compravendita di immobili, testamenti, recupero crediti e istanze di divorzio e ci si può rivolgere a loro direttamente. Alcuni sono qualificati a rappresentare i propri assistiti sia nelle cause civili che in quelle penali. I "barristers" non trattano direttamente con i clienti ma intervengono dietro richiesta del "solicitor": sono qualificati per esercitare nei tribunali di grado superiore, mentre i "solicitors" in quelli di grado inferiore. I reati minori sono invece di competenza delle "magistrates' courts", di fronte a un magistrato ma senza giuria. Le "local courts" si occupano della maggior parte dei processi civili di minore entità, mentre quelli più complessi vengono giudicati dalla "High Court". In appello, sia i processi penali che quelli civili si svolgono in primo grado di fronte alla " Court of Appeal" e in ultima istanza di fronte alla Camera dei Lord. Nel sistema giudiziario scozzese la High Court of Justiciary si occupa dei processi penali per i reati più gravi e le sheriff courts di quelli per i reati minori.
