апелляционный орган
В соответствии с Классификационным кодексом МПК, Апелляционный орган имеет юрисдикцию в отношении рассмотрения решений по поводу классификации с целью:
• обеспечения соблюдения соответствующих процедур присвоения спортивного класса;
• обеспечения соблюдения соответствующих процедур опротестования.
Апелляционный орган не имеет юрисдикции в отношении рассмотрения конкретных обстоятельств установления спортивного класса или статуса спортивного класса. Ни при каких условиях Апелляционный орган не может изменить решение по классификации путем присвоения спортсмену нового спортивного класса и/или статуса спортивного класса. Апелляционный орган имеет право проводить слушания по апелляциям только в случаях, когда все другие доступные средства защиты прав, включая без ограничений процедуры опротестования, исчерпаны.

appeal body
According to the IPC Classification Code, the Appeal Body shall have jurisdiction to review classification decisions in order to:
• ensure that all appropriate sport class allocation procedures have been followed
• ensure that all appropriate protest procedures have been followed.
Appeal Body shall have jurisdiction to review the merits of an allocation of sport class or sport class status. Under no circumstances shall the Appeal Body modify a classification decision by allocating an athlete a new sport class and/or sport class status. The Appeal Body shall hear appeals only in cases in which all other available remedies, including but not limited to protest procedures, have been exhausted.

апелляционные процедуры
Согласно классификационному кодексу МПК после подачи апелляции Международная Паралимпийская спортивная федерация:
• сообщает всем соответствующим сторонам о том, что для рассмотрения апелляции будет сформирован апелляционный орган;
• направляет копию уведомления об апелляции и все прилагаемые документы, доказательства и данные свидетелей стороне, указанной в уведомлении об апелляции (противная сторона);
• сообщает противной стороне, что та должна в течение 28 календарных дней с момента получения уведомления об апелляции (или в течение иного срока, указанного МПСФ) представить в апелляционный орган перечень всех документов, доказательств и экспертов-свидетелей, которые будут предложены противной стороной в связи с апелляцией;
• устанавливает место и дату слушания: апелляционный орган имеет право по своему усмотрению провести слушания при личном присутствии сторон, по телефону или видеосвязи.

appeal procedures
According to the IPC Classification Code after submission of the appeal the IPSF shall:
• advise all relevant parties that an Appeal Body will be constituted for the purposes of hearing the appeal
• send a copy of the notice of appeal, and all documents, evidence and details of witnesses to the party named in the notice of appeal (the opposing party)
• advise the opposing party that it must, within 28 calendar days of receiving a notice of appeal (or within such other period required by the IPSF) submit to the Appeal Body a list of all documents, evidence and expert witnesses to be offered by the opposing party in relation to the appeal
• set a hearing location and date: the Appeal Body shall have the right, in its sole discretion, to conduct a hearing live, by telephone conference or by video conference.

решение по апелляции
Как указано в Классификационном кодексе МПК, апелляционный орган выносит письменное решение по результатам слушаний. Копия решения предоставляется всем сторонам, МПК и Оргкомитету. Апелляционный орган либо утверждает обжалуемое решение, либо его отменяет. В случае отмены решения в письменном заключении апелляционного органа должна быть указана допущенная процедурная ошибка и дано распоряжение о пересмотре решения соответствующей стороной в соответствии с указаниями апелляционного органа. Решения по апелляциям являются окончательными и обжалованию не подлежат.

appeal decision
As stated in the IPC Classification Code, the Appeal Body shall issue a written decision resolving any appeal after the hearing. The decision shall be provided to all parties, to the IPC, and to the Organizing Committee. The Appeal Body shall either affirm the decision appealed or overrule the decision. If the decision is overruled, the Appeal Body’s written opinion shall specify the procedural error committed and shall direct the appropriate party to reconsider the decision in a manner consistent with the Appeal Body’s instructions. Appeal decisions are final and are not subject to any further appeal.

слушания по апелляции
Как указано в Классификационном кодексе МПК, место и дату слушания по апелляции устанавливает МПСФ. Апелляционный орган вправе назначить адвоката для оказания помощи в ходе слушаний. Помимо спортсмена и переводчика, в слушаниях имеют право участвовать не более двух представителей каждой стороны. Каждая сторона имеет право представить документальные доказательства, меморандум слушаний или краткое письменное изложение дела, а также (по усмотрению апелляционного органа) вызывать свидетелей.

appeal hearing
As stated in the IPC Classification Code a location and date of the appeal hearing are set by the IPSF. The Appeal Body may designate counsel to assist it in the hearing. Not more than two representatives of any party, apart from the athlete and the interpreter, are entitled to participate in the hearing. Each party shall have the right to offer documentary evidence, to submit a hearing memorandum or brief, and (subject to the Appeal Body’s discretion) to call witnesses.
