Изменения облегчили процедуру подачи петиций; были внесены дополнения относительно ранее признаваемого абсолютным правила приоритетности обеспеченных кредиторов всех категорий; федеральные суды по делам банкротств получили большие полномочия в отношении слушания соответствующих дел.
Закон содержит также оговорку относительно проведения проверок способности должника оплатить долги, предусмотренного разделом 13 Закона о банкротстве. В соответствии с разделом 11 (Chapter 11) фирма может обратиться в суд с требованием защиты от кредиторов, если в данный момент она проводит реорганизацию, направленную на погашение долгов.
