Запрещал президенту увольнять с должности без согласия Сената [ Senate, U.S.] лиц, назначенных "по совету и с согласия" [ advice and consent] последнего. Авторы закона - радикальные республиканцы - стремились тем самым закрепить на своих постах государственных деятелей, сочувствующих проводимой ими политике радикальной реконструкции [ Radical Reconstruction] Юга, в первую очередь военного министра Э. Стэнтона [ Stanton, Edwin McMasters]. Несмотря на это, 1 февраля 1868 Джонсон отправил Стэнтона в отставку, чем немедленно спровоцировал дело об импичменте [ impeachment].
