Список из 25-300 (или более) граждан, составляемый должностным лицом, из которого участники процесса (обвинение и защита при решающем слове судьи) выбирают присяжных заседателей. Из составленного списка по жребию выбирается первая группа присяжных, которую представители обвинения и защиты подвергают допросу с целью отвода кандидатов, заведомо пристрастных или заранее составивших себе мнение по данному делу. Обе стороны имеют право на отвод [challenge], допускается неограниченное число обоснованных отводов [challenge for cause] и строго ограниченное количество произвольных отводов [peremptory challenge]. Поводом для обоснованного отвода служит любое указание на возможную необъективность присяжного; произвольный отвод удовлетворяется судьей без дальнейших вопросов. Если при этом не удается сразу набрать нужное число присяжных (12-23 человека), процедура повторяется до тех пор, пока нужное число присяжных не будет набрано. -
