интеллектуальная собственность
Совокупность исключительных прав на результаты интеллектуальной деятельности, а также на приравненные к ним средства индивидуализации. И.с. – это собирательное понятие, охватывающее права на: результаты интеллектуальной (творческой) деятельности в области литературы, искусства, науки и техники, а также в других областях творчества; средства индивидуализации участников гражданского оборота товаров или услуг; защиту от недобросовестной конкуренции. Использование результатов интеллектуальной деятельности и средств индивидуализации, которые являются объектом исключительных прав (интеллектуальной собственности) гражданина или юридического лица, осуществляется только с согласия правообладателя на основе лицензионных и авторских договоров.
