2 Tenth Amendment
Часть Билля о правах [ Bill of Rights]. Определяет принцип федерализма американской государственной системы: "Полномочия, не делегированные Соединенным Штатам Конституцией, и не запрещенные ею для штатов, сохраняются соответственно за каждым штатом или за народом" ["The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people"]. Хотя "сохраняемые за штатами (зарезервированные) права [ reserved powers]" в поправке не перечисляются, традиционно они включали вопросы местного самоуправления, образования, регулирования торговли, трудовых отношений и бизнеса, наследования, а также вопросы брака, разводов и иных семейных отношений. 4 Constitutional Amendment
1) Одна из 27 поправок к Конституции США [ Constitution of the United States], принимавшихся с 1791 по 1992. Первые 10 поправок вошли в историю под названием Билля о правах [ Bill of Rights]. 27-я поправка, ратифицированная в 1992, установила, что любое решение о повышении жалования члена Конгресса вступает в силу только после следующих выборов. Процедура принятия поправок в целом регулируется Статьей V Конституции. После принятия текста поправки 2/3 голосов членов обеих палат Конгресса [ Congress, U.S.] она предлагается на ратификацию штатам и считается принятой при ратификации 3/4 законодательных собраний штатов. 5 Bill of Rights
Первые десять поправок к Конституции США [ Constitution, U.S.], принятые первой сессией Конгресса США [ Congress, U.S.] 15 декабря 1791 и гарантирующие основные права граждан США. Конституция определяла далеко не все права человека. Билль о правах первоначально ограничивал лишь действия федеральной власти, и в нем не предусматривалось ограничение действий властей штатов, которые могли бы угрожать правам человека. Штаты имели собственные конституции, в некоторых из них содержались собственные билли о правах, включающие те же или сходные права. Проблема заключалась в том, что не все штаты гарантировали эти права, а там, где они гарантировались, их по-разному интерпретировали суды штатов. Билль о правах предусматривал свободу слова, печати, собраний, вероисповедания, право владения оружием, неприкосновенность личности, имущества и личных бумаг, соблюдение прав граждан, привлеченных к судебной ответственности и др.
