•• В сознании каждого американца глубоко укоренено понятие due process. В Новом БАРСе вы найдете словосочетание due process of law и его перевод законный порядок. Перевод неудачный. Due process означает соблюдение предусмотренных законом процедур (процессуальных норм). Нет в словаре и другого широко распространенного выражения due diligence. Оно означает проверка благонадежности (финансового состояния) делового партнера или (юридической) чистоты сделки. Впрочем, эти переводы не полностью передают весь объем значений и подтекста, связанных с этим термином. Поэтому иногда дают обобщенный (и упрощенный) перевод необходимые формальности или («в осведомленных кругах») прибегают к кальке с английского в русской транскрипции. В переводных юридических текстах используется крайне неуклюжий и неточный перевод должная/ надлежащая заботливость. К сожалению, отказаться от этого варианта в юридических переводах, видимо, уже невозможно, поскольку замена устоявшихся клише влечет за собой последствия. Интересно, что компания, не принявшая необходимых мер для такой проверки, может быть обвинена в negligence (халатное, безответственное отношение к своим обязанностям, наносящее ущерб акционерам). Due diligence употребляется и в переносном смысле. Вот пример из журнала Time: Lewis does due diligence by Clinton and Dole, but spends most of his time listening to Morry Taylor’s curses, Pat Buchanan’s poetry and Alan Keyes’ messianic rantings. Речь идет о журналисте, написавшем книгу о президентской кампании 1996 года. В переводе примерно так: Льюис не обходит своим вниманием Клинтона и Доула, но большую часть времени уделяет проклятиям, раздающимся из уст Морри Тейлора, поэтическим откровениям Пэта Бьюкенена и сумбурным речам возомнившего себя мессией Алана Кийза.
•• Вообще, слово due употребляется очень широко. Женщину на последнем месяце беременности могут спросить When are you due? Объясняя географическое направление, скажут It is due North (то же самое, что It is to the North of here). Date due или просто due на счете (bill) – срок оплаты.
